U.S. Court Rules Pentagon's Blacklisting of Anthropic Illegal

On August 27, the U.S. District Court for the Northern District of California ruled that the U.S. Department of Defense’s placement of artificial intelligence company Anthropic on a supply chain “blacklist” was unlawful. The court stated that the sanction constituted direct retaliation against Anthropic for its public criticism of the government, violating the First Amendment’s protection of free speech. Additionally, the government failed to provide prior notice or a hearing before imposing the sanction, thereby violating the Fifth Amendment’s guarantee of due process. The court also held that the government’s actions were inconsistent with the Administrative Procedure Act in terms of factual basis, logic, and procedure. While the ruling supports Anthropic’s claims in this lawsuit, the company must still secure a separate victory in Washington, D.C., to fully overturn its “blacklist” designation.
