OpenAI Moves to Dismiss Apple's Trade Secret Lawsuit, Citing Lack of Evidence

OpenAI recently filed a motion in court seeking to have Apple's trade secret lawsuit against it dismissed entirely. OpenAI stated that Apple's allegations lack concrete evidence and are largely based on speculation. The lawsuit stems from former Apple employees Chang Liu and Tang Tan, whom Apple accuses of stealing trade secrets and instructing newly hired OpenAI employees to circumvent Apple’s security checks. The two defendants argue that they retained documents after leaving Apple solely to help new OpenAI hires comply with security protocols—not to obtain or disseminate Apple’s trade secrets. OpenAI’s legal team emphasized that Apple has provided no specific information showing the former employees misused confidential information, nor has it presented clear evidence demonstrating economic harm resulting from any alleged disclosure. A hearing on OpenAI’s motion to dismiss is scheduled for October 1. If the court grants the motion, the case could be permanently dismissed, barring Apple from refiling the same claim.
