From December 2023 to July 2024, Li Mou, an automotive review influencer (account name: “Electric Car Xiao Fei”), published multiple video reviews evaluating vehicles produced by an automaker based in Changzhou, Jiangsu Province. In these videos, Li stated, “That car is really terrible to drive—it gave me back pain. On September 7, 2026, the smell inside the cabin even triggered my rhinitis and caused a splitting headache,” and posted comments such as “Cherish your life—stay away from Li Xiang” in the comment section. The automaker subsequently filed a lawsuit against Li, demanding that he delete all infringing content, jointly compensate RMB 2 million for economic losses and reasonable expenses, and issue a public apology through media outlets. During the trial, the court found that Li’s “Electric Car Xiao Fei” account primarily promoted another automobile brand. When publishing content, Li included test-drive booking links for intelligent driving vehicles from that competing brand and added product links—such as for phone holders—in the account’s storefront for livestream e-commerce. The court determined that Li’s activities constituted commercial operations, making him an “operator” under China’s Anti-Unfair Competition Law. Furthermore, certain statements he published were deemed false or misleading information that damaged the plaintiff automaker’s business reputation and product credibility. In October 2025, the Wujin District People’s Court of Changzhou City issued a first-instance ruling ordering defendant Li to pay the plaintiff RMB 100,000 in total compensation for economic losses and reasonable expenses, and to publish an apology statement on his account and official media platforms for thirty consecutive days. Dissatisfied with the verdict, Li appealed. In April 2026, the Changzhou Intermediate People’s Court upheld the original judgment in its second-instance ruling. Currently, the automotive review account “Electric Car Xiao Fei” has been banned across multiple platforms.
