Recently, a traffic accident occurred on Longdong Avenue in Shanghai's Pudong New Area. A black SUV, operating with its driver-assistance system engaged, collided with a stationary road maintenance vehicle ahead at 83 km/h—exceeding the posted speed limit for that section of road. The crash happened because the driver became distracted while picking up a beverage bottle inside the vehicle and failed to take timely control of the car. Two road maintenance workers were injured, one of whom later died despite emergency medical efforts. Technical inspections confirmed that the SUV’s steering system, braking system, and driver-assistance functions were all operating normally, and tests ruled out alcohol or drug impairment on the part of the driver. Police investigations concluded that the driver bore primary responsibility for the accident due to overreliance on the driver-assistance system, distracted driving, and speeding. The road maintenance company was found secondarily liable for failing to set up required safety protection measures at the work site. Authorities have reminded the public that currently available driver-assistance systems in vehicles are generally classified as Level 2 (L2), offering only supportive functions and not replacing human drivers. Should drivers take their hands off the wheel, eyes off the road, or become otherwise distracted while using these systems, they significantly increase the risk of serious accidents—and any resulting legal liabilities rest solely with the driver.
